Summary: These Terms and Conditions constitute a legally binding agreement between you and AVM AUDIO VIDEO RECORDING STUDIO ("Company", "we", "us", or "our"), operating under the brand name CreatorMitra ("Platform", accessible at creatormitra.co.in). By registering or using our mobile application and services, you agree to comply with all platform rules, milestone acceptance deadlines, and payment terms.

1. Acceptance of Terms

By creating an account, downloading the CreatorMitra mobile application (Android / iOS), or accessing our services via creatormitra.co.in, you agree to be bound by these Terms and Conditions ("Terms") established by AVM AUDIO VIDEO RECORDING STUDIO. If you do not agree to these Terms, you must not access or use the platform.

2. Eligibility & Account Registration

  • Age Requirement: You must be at least 18 years of age and legally capable of entering into binding contracts.
  • OTP Verification: Account creation requires a valid Indian mobile number verified via OTP authentication.
  • Account Integrity: You are solely responsible for maintaining the confidentiality of your credentials and all activities occurring under your account.

3. Roles & Responsibilities

A. For Advertisers (Brands)

  • Clear Campaign Briefs: Advertisers must provide clear campaign briefs, brand instructions, talking points, and specific hashtags when placing an order.
  • Milestone Approvals: Advertisers agree to review draft content uploaded by creators in a timely manner (within 48 hours).
  • Prohibited Products: Campaigns for illegal substances, gambling, counterfeit goods, or deceptive financial schemes are strictly prohibited.

B. For Influencers (Creators)

  • Order Acceptance SLA: Influencers have a strict deadline (standard 48 hours) to accept or reject an incoming order. Unaccepted orders are auto-cancelled.
  • Authentic Deliverables: Influencers must create original, high-quality content matching the agreed deliverable package (e.g. 1 Reel, 2 Stories).
  • Draft Submission: Influencers must submit draft content within the platform for advertiser approval prior to posting publicly on Instagram.
  • Live URL & Retention: Published promotional content must remain live on the creator's social handle for a minimum of 30 days unless otherwise agreed.

4. Order Lifecycle & Dispute Resolution

CreatorMitra implements an automated milestone tracking engine:

  1. Order Placement & Escrow: The Advertiser deposits the full package amount (including GST/platform fees) into escrow.
  2. Acceptance & Production: Upon creator acceptance, the creator shoots and uploads video deliverables.
  3. Review & Revision: The Advertiser reviews the draft. If minor adjustments are required, a concern can be raised inside the app.
  4. Live Verification & Payout: Once approved and published live, the live URL is logged, and the net payout is released to the creator's bank account.
  5. Escalation to Admin: If an unresolvable dispute arises regarding content compliance, either party may escalate to CreatorMitra Admin for final mediation.

5. Fees, Subscriptions & Payments

  • Escrow Protection: Payments are held safely until milestone conditions are verified.
  • Influencer Payouts: Net influencer earnings are disbursed via automated RazorpayX IMPS/NEFT/UPI transfers.
  • Influencer Subscriptions: CreatorMitra may offer trial or paid subscription plans for influencers to receive unlimited brand orders. Subscription fees are non-refundable once activated.

6. Intellectual Property & Content Licensing

Creators retain moral authorship of the content they produce. However, by accepting a brand order, the Creator grants the Advertiser a non-exclusive license to repost and promote the agreed deliverable across their official marketing channels for the agreed campaign period.

7. Limitation of Liability

CreatorMitra provides a technology marketplace and does not guarantee specific sales ROI or viral reach for any campaign. To the maximum extent permitted by applicable Indian law, CreatorMitra shall not be liable for indirect, incidental, or consequential damages arising out of your use of the platform.

8. Termination of Account

CreatorMitra reserves the right to suspend or terminate accounts that violate community standards, engage in artificial follower manipulation, fail repeated delivery deadlines, or attempt off-platform payment transactions to circumvent platform security.

9. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
